This Terms and Conditions of Use Agreement (hereinafter, “Terms”) is made by and between Piece of Mind, LLC of Lakewood, Colorado, (hereinafter, "Piece of Mind" or "PoM"), and you the user (“you,” “your,” “User,” or “donor”). This Agreement, in addition to our Privacy Policy, contain the complete terms and conditions that govern the use of Piece of Mind’s website, www.pieceofmind.insure (the "Site").

BY ACCESSING, VISITING, BROWSING, USING OR ATTEMPTING TO INTERACT WITH OR USE ANY PART OF THE SITE OR OTHER PIECE OF MIND SERVICES OR CONTENT (COLLECTIVELY "SERVICES"), YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT.

IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THE SITE. PIECE OF MIND RESERVES THE RIGHT, WITH OR WITHOUT NOTICE, TO MAKE CHANGES TO THIS AGREEMENT AT PIECE OF MIND'S DISCRETION. CONTINUED USE OF ANY PART OF THE SITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES.

THE MOST CURRENT VERSION OF THIS AGREEMENT, WHICH SUPERCEDES ALL PREVIOUS VERSIONS, CAN BE REVIEWED HERE.

To access the Site and use our Services, you may be asked to create an account and provide registration details or other information. It is a condition of your use of the Site that all the information you provide will be correct, current, and complete. If Piece of Mind believes the information you provide is not correct, current, or complete, Piece of Mind has the right to deny access to the Site, Piece of Mind’s Services or to any of its resources, and to terminate or suspend your access at any time.

The Site is intended for use by individuals 18 years of age or older. You may not use the Site or use Piece of Mind’s Services under any circumstances if you are less than 18 years old. By using the Site, you warrant and represent that you are at least 18 years old.

As a condition of your use of the Site and Piece of Mind’s Services, you warrant to Piece of Mind that you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

During the first X days from the purchase date of your policy, claims do not pay out 100%; this is considered the initiation period.

1. For pieces valued over $0.00 and less than or equal to $500.00: initiation period of 90 days
1. Claims submitted within 0 - 30 days of purchase date = 50% claim payout
2. Claims submitted within 31 - 60 days of purchase date = 60% claim payout
3. Claims submitted within 61 - 89 days of purchase date = 75% claim payout
2. For pieces valued over $500.00 and less than or equal to $1,000.00: initiation period of 180 days
1. Claims submitted within 0 - 60 days of purchase date = 50% claim payout
2. Claims submitted within 61 - 120 days of purchase date = 60% claim payout
3. Claims submitted within 121 - 179 days of purchase date = 75% claim payout
3. For pieces valued over $1,000.00: initiation period of 365 days
1. Claims submitted within 0 - 121 days of purchase date = 50% claim payout
2. Claims submitted within 122 - 244 days of purchase date = 60% claim payout
3. Claims submitted within 245 - 364 days of purchase date = 75% claim payout

All claims are reviewed by an underwriter and are subject for denial if pictures are not submitted or foul play is observed, claims can be declined. Peace of Mind reserves the right to deny any claims. Your Piece of Mind account must be active and in good-standing to be eligible for a 100% claim payout. To be eligible for a 100% claim payout, you must upload an image of your broken piece. Unless insured separately, stems, heads, and other coverings are not included in the coverage. Separately insured items must have a minimum value of $30. A claim should only be submitted when the glass piece is unusable. All broken pieces should be properly recycled. Please handle all broken glass with care.

To be eligible for coverage, all pieces must be operational; a piece video submission maybe required. If no payment is received 30 days past the due date, your account will not lnger be in good standing until the account is paid in full. There will be a $0.25 a day late fee for all past due accounts.Unless insured separately, stems, heads, and other coverings are not included in the coverage. Separately insured items must have a minimum value of $30.

You may not use or authorize any party to co-brand or frame the Site without the express prior written permission of an authorized representative of Piece of Mind. For purposes of these Terms, "co-branding" means to display a name, logo, trademark, or other means of attribution or identification of any party in such a manner as is reasonably likely to give a user the impression that such other party has the right to display, publish, or distribute the Site; content accessible within the Site; or content transmitted through the Site. For purposes of these Terms, "framing" refers to displaying any part of the Site within a bordered area of another website, regardless of whether the address of the Site or the originating Piece of Mind posting is visible. Furthermore, you agree to cease any unauthorized co-branding or framing immediately, upon notice from Piece of Mind.

In addition, you agree that you will not use the Site in any manner that could in any way disable, overburden, damage, or impair the Site or otherwise interfere with any other party's use and enjoyment of the Site. You further agree that you will not obtain, or attempt to obtain, any materials, content, or information by any means not expressly made available or provided for through authorized use of the Site.

Subject to our Privacy Policy, any communication, images, photographs, information or other material submitted by you to Piece of Mind through this Site, by email, upload, or by other means, for any reason, will be treated as non-confidential and non-proprietary user content (the "Submissions"). While you retain all ownership rights to the Submissions, you hereby grant to Piece of Mind a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to use, transmit, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display the Submissions. You agree that Piece of Mind will not be bound to treat any Content as confidential and may use any Submissions in its business (including without limitation, for advertising) without incurring any liability for royalties or any other consideration of any kind, and will not incur any liability as a result of any similarities that may appear in future Piece of Mind operations or business.

All content and works found on the Site originating from Piece of Mind (the "Content") is considered the copyrighted and trademarked intellectual property of Piece of Mind, or of the party that created and/or licensed the Content to Piece of Mind. All contents of the Site provided by Piece of Mind are: Copyright © 2022 Piece of Mind. All rights reserved. No rights or title to any of the works contained on the Site shall be considered transferred or assigned to the User. You agree that you will not copy, distribute, republish, modify, create derivative works from, or otherwise use the Content in any way, without the prior written consent of Piece of Mind or the owner of such Content.

Trademarks, service marks, logos, and copyrighted works appearing in the Site are the property of Piece of Mind or the party that provided them to Piece of Mind. Piece of Mind, and any party that provides intellectual property to Piece of Mind, retain all rights with respect to any of their respective intellectual property appearing in the Site.

Piece of Mind grants you a limited, revocable, nonexclusive license to use the Site solely for your own personal purposes only and not for republication, distribution, assignment, sublicense, sale, commercial use, preparation of derivative works, or other use. You may not use any Content from the Site for commercial use. You agree not to copy the site, reverse engineer or break into the site, or use materials, Content or services in violation of any law. Any use of the Site or the Content or materials contained therein, other than as specifically authorized in these Terms, without the prior written permission of Piece of Mind, is strictly prohibited and will terminate the license granted herein. Unless explicitly stated herein, nothing in the Terms shall be construed as conferring to you, whether by implication, estoppel or otherwise, any title or ownership of, or exclusive use-rights to, any intellectual property or other right and any goodwill associated therewith. Piece of Mind reserves the right, without notice and in its sole discretion, to terminate your license to use the Site at any time and to block or prevent your future access to, and use of, the Site.

The Site may be hyperlinked to and by other websites which are not maintained by, or related to, Piece of Mind. Hyperlinks to such sites are provided as a service to Users and are not sponsored by, endorsed or otherwise affiliated with the Site or Piece of Mind. Piece of Mind has not reviewed any or all of such sites and is not responsible for the content of any linking sites, and any links made directly from the Site to another web page should be accessed at the User's own risk. Piece of Mind makes no representations or warranties about the content, completeness, quality or accuracy of any such third party website.

You agree that you will not post, send, submit, publish, or transmit in connection with the Site, or cause to be posted, sent, submitted, published or transmitted, any Submissions or material that:

Piece of Mind reserves the right to monitor use of the Site to determine compliance with these Terms, as well as the right to edit, refuse to store, receive, transmit or remove any information, Content or materials, in whole or in part, at its sole discretion. Piece of Mind reserves the right to terminate your access to any or all of the Services at any time without notice for any reason whatsoever.

Piece of Mind reserves the right at all times to disclose any information or Content as necessary to satisfy any applicable law, regulation, legal process or governmental request.

Piece of Mind cautions you against giving out any personally identifying information about you in any Content. In an effort to preserve your privacy, Piece of Mind agrees that it will treat any personally identifying information that you submit through this Site in accordance with the terms outlined in its Privacy Policy.

You understand that Piece of Mind cannot and does not guarantee or warrant that files available for downloading from the Piece of Mind website will be free of viruses, worms, Trojan horses or other code that may cause damage or harm to your computer(s) or network(s). You acknowledge that you will be solely responsible for implementing sufficient procedures and checkpoints to protect your computer(s) and network(s), and that you will maintain adequate means of backup of your personal data, external to this website. Piece of Mind makes no representation, endorsement, or warranty, and further disclaims any responsibility to ensure, that the Content located on the Site is complete, up-to-date, accurate, or suitable for any particular purpose.

IN NO EVENT WILL THE COLLECTIVE LIABILITY OF PIECE OF MIND AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE), EXCEED THE GREATER OF $100 OR THE AMOUNT YOU HAVE PAID TO PIECE OF MIND FOR THE APPLICABLE CONTENT OR SERVICE OUT OF WHICH LIABILITY AROSE.

You agree to indemnify and hold Piece of Mind, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, members, and contractors (the Indemnified Parties) harmless from any breach of these Terms by you, including any use of Content other than as expressly authorized in these Terms. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys' fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information accessed from this site.

Please note that this procedure is exclusively for notifying Piece of Mind and its affiliates that your copyrighted material has been infringed. Please include the following:

Any passwords used for this site are for individual use only. You will be responsible for the security of your password(s). From time to time, Piece of Mind may require that you change your password. You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password crackers, rootkits, Trojan horses, or network probing tools) is strictly prohibited. If you become involved in any violation of system security, Piece of Mind reserves the right to release your account details to system administrators at other websites and/or the authorities in order to assist them in resolving security incidents. Piece of Mind reserves the right to investigate suspected violations of these Terms. Piece of Mind reserves the right to fully cooperate with any law enforcement authorities or court order requesting or direction Piece of Mind to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms.

BY ACCEPTING THIS AGREEMENT YOU WAIVE ALL RIGHTS AND AGREE TO HOLD PIECE OF MIND HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY PIECE OF MIND DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER PIECE OF MIND OR LAW ENFORCEMENT AUTHORITIES.

Although the Site may be accessible worldwide, those who choose to access the Site from other locations do so on their own initiative and at their own risk. If you choose to access the Site from outside the United States, you are responsible for compliance with local laws in your jurisdiction, including but not limited to, the taxation of products purchased over the Internet. Any offer for any service, and/or information made in connection with the Site is void where prohibited. We make no claims or representations that the Site content and Services may be lawfully viewed or accessed outside of the United States. Access may not be legal by certain persons or in certain countries. If You access the Site, You do so at Your own risk and are responsible for compliance with the laws of Your jurisdiction. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Piece of Mind as a result of this agreement or use of the Site. These Terms and the Site Privacy Policy constitute the entire agreement among the parties relating to this subject matter and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written between the user and Piece of Mind with respect to the Site. Notwithstanding the foregoing, any additional terms and conditions on the Site will govern the items to which they pertain. Piece of Mind may revise these Terms at any time by updating this posting.

Privacy Policy

At Piece of Mind, LLC (referred to as "Piece of Mind", "PoM", "us" or "we"), we recognize that your privacy is important, and we are strongly committed to protecting your privacy. This Policy discloses the privacy practices for the Piece of Mind website, pieceofmind.insure (the "Site"), as well as related products and services we may offer to you (collectively referred to as the "Services"). This Policy also covers how personal and other information that we receive or collect about you is treated. Please read the information below to learn the following regarding your use of this Site.

You acknowledge that this Privacy Policy is designed to be read in connection with the Site Terms of Use, which are available here and that by accessing or using our Site, you agree to be bound by the Site's Terms of Use and this Privacy Policy.

We reserve the right to change this Privacy Policy from time to time. In order to better provide you with services, we collect two types of information about our users: Personally Identifiable Information ("PII") and Aggregate Information.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this Site, such as registering for an account, requesting a quote, filing a claim, or sending us feedback, we may ask you to provide certain information about yourself.
Examples of PII may include your first and last name, email address, mailing address (including postal/zip code), telephone and facsimile numbers, and other identifying information. When making a donation, you will be asked to provide a valid credit card number and/or PayPal payment account information. Please note that your credit card number and/or billing address is never stored permanently within the Site.

Aggregate Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Site and what other sites may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website's Uniform Resource Locator ("URL") that points to the site you just came from, which URL you go to after visiting our Site, what browser you are using, and your Internet Protocol ("IP") address.

We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use certain services available on the Site. These may include: (a) registering for an account on our Site; (b) sending us an email message; (c) submitting your credit card or PayPal payment information when ordering and purchasing products and services on our Site. When processing certain information, such as payment information with affiliated payment processors such as Paypal.com, we encrypt the transaction, using Secure Socket Layer (SSL) encryption technology, in order to prevent your PII from being stolen or intercepted. Additionally, your credit card information is never stored on our servers.

We will primarily use your PII to provide product or service offerings to you. We will also use certain forms of PII to enhance the operation of our Site, improve our internal marketing and promotional efforts, statistically analyze Site use, improve our product and service offerings, and customize our Site's content, layout, and services. Depending on how you use our Site, we may store cookies on your computer in order to collect certain aggregate data about our users and to customize certain aspects of your specific user experience. A cookie is a small data text file which is stored on your computer that uniquely identifies your browser. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and your first name to welcome you back to our Site. We may use cookies to perform tasks such as: monitoring aggregate site usage metrics, storing and remembering your passwords (if you allow us to do so), storing account and advertising preferences that you have set, and personalizing the Services we make available to you. However, we do not use cookies to track your browsing behaviors.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some aspects of the Site may not function properly if you elect to disable cookies.

Although Piece of Mind collects your PII through the Site, we will never sell, trade, or rent your PII to others. We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties ("Service Partners"). We and our Service Partners may need to use some PII in order to perform tasks between our respective sites, or to deliver products or services to you. For example, we must release your credit card information to authorize and to confirm payment for products and services purchased on this Site; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service. We will encourage our Service Partners to adopt and promote strong privacy policies. However, the use of your PII by our Service Partners is governed by the respective privacy policies of those providers and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other Sites accessible through this Site, including our Advertising and Service Partners, have their own privacy policies and data collection, use and disclosure practices. Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

We may also provide Aggregate Information about our customers' sales, traffic patterns, and related Site information to third party advertisers, but these statistics do not include any Personally Identifiable Information.

We believe you should have the ability to access and edit the PII that you have provided to us. You may change any of your PII in your account online at any time by logging into your account and selecting the Update Profile menu link.

We encourage you to promptly update your PII if it changes. You may ask to have the information on your account deleted or removed; however, some information, such as past transactions, logs of technical support calls, or other information may not be deleted. In addition, it may be impossible to completely delete your information without some residual information because of backups.

We may, from time to time, send you email regarding new products and services that we feel may interest you. In addition, if you indicated upon registration that you are interested in receiving offers or information from us and our partners, we may occasionally call or send you direct mail about products and services that may be of interest to you. Only Piece of Mind (or agents working on behalf of Piece of Mind and under confidentiality agreements) will send you these solicitations, and only if you have previously indicated that you wish to receive them. If you do not want to receive solicitations from us, you can "opt-out" by e-mailing us at support@pieceofmind.insure.

You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Site may not work properly in your case.

At our Site you can be assured that your PII is secure and consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII. We work hard to ensure that the data we collect is reliable, accurate, complete and current. We also only keep collected information only for as long as reasonably necessary and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.

In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents (such as Paypal.com/SquareConnect). They receive the information needed to verify and authorize your credit card or other payment information and to process your order. Piece of Mind does not store any credit card information on our servers.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.
